1. Acceptance of Terms
By accessing and using the services of SMART BYTE LABS, you agree to these Terms of Service.
If you do not agree, please do not use our services.
2. Services Description
SMART BYTE LABS provides software development and IT services, including:
- Web application development
- Mobile application development
- Cloud infrastructure and DevOps services
- Software consulting and technical advisory
- Maintenance and support services
3. Client Responsibilities
Clients agree to:
- Provide accurate project information
- Respond in a timely manner
- Pay fees as agreed
- Respect intellectual property rights
- Comply with applicable laws
4. Payment Terms
Unless otherwise agreed in writing, project build fees follow this payment cycle:
- 50% advance — due when scope is approved and work begins
- 25% on first deployment — due when the project is first deployed to staging or production
- 25% on completion — due once all agreed feedback changes are completed and signed off
- Invoices are due within 30 days of issue unless stated otherwise
- Late payments may incur charges; projects may be paused for non-payment
- Prices exclude applicable taxes
5. Intellectual Property
Upon full payment, clients receive ownership of custom-developed code,
excluding pre-existing and third-party components.
6. Warranties and Disclaimers
Services are provided “as is” without warranties of any kind.
7. Limitation of Liability
SMART BYTE LABS is not liable for indirect or consequential damages.
8. Confidentiality
Client information is kept confidential except where required by law.
9. Termination
Either party may terminate with written notice.
10. Governing Law
These terms are governed by the laws of India.
